Dear Chairman Palladino and Members of the Commission:

On behalf of the Joint Intervenors to the above-entitled proceeaing, I am writing to oppose issuance of a license for fuel loading and operation of the Diablo Canyon Nuclear Power Plant, Unit 2.

The Commission has scheduled a possible vote on April 23, 1985 with respect to Pacific Gas and Electric Company's application for such authorization.

The Joint Intervenors' opposition is based on the grounds previously relied upon and presented by them to the Com-mission in their opposition to licensing of Unit 1.

In addition, although ALAB-763 sets forth the Commission's essential findings i

regarding quality assurance in the design of Unit 1, the Appeal Board explicitly severed all questions relating to quality assur-ance in the design of Unit 2, holding that "the licensing authorization previously granted for that unit is not effective."

ALAB-763, at 19-20, 101-02 (March 20, 1984).

Since that time, the Appeal Board has iscued no decision on that critical issue.

Until 1

it does so, no license may lawfully be issued.
