concerning scheduling of ressenses to our request for stay, it is L

cbvious that the Commission vill nako no decision on our request e

until some time next-week at the earliest.

On February 5, 1990, the. Honorable Fern M. Smith, United States District Court Judge for the Northern District of California, lifted the Temporary l

. Restraining Order prohibiting the random testing at Diablo Canyon cnd also transferred thei case to the United States Court of Appeals L

for the Ninth Circuit.

As you know, we intend to file this afternoon a request with H

the Ninth circuit for an emergency stay of the Commission's random l

' drug t, sting order insofar as.-it affects the employees covered by e

the lawsuit.

In light of all of the foregoing developments, I am requesting, on behalf of the class of Plaintiffs in the above natter, that the Commission immediately order PG&E to refrain from any random drug testing until such time as the

-conductingConaission and/or the United States Court of Appsals for the Ninth circuit rules on our respective requests for stay.
