Dear Chairman Palladino and Members of the Commission:
Enclosed please find the Joint Intervenors' Application for Stay, filed today with the Appeal Board in the above-entitled proceeding.
In order to ensure an opportunity for Commission review concurrent with its scheduled July 30, 1985 vote on the full power operating license for Unit 2 should the Appeal Board deny the stay application, the Joint Intervenors are forwarding the application to you at this time.
In the event that the Commission votes (1) to issue the license and (2) to deny the stay application, the Joint Intervenors respectfully request that the Commission grant a limited' stay of one week to permit them to apply to the United States Court of Appeals for the District of Columbia Circuit for an emergency stay of the license pending appeal.
The Commission granted such a request in April and August 1984 when it voted to issue low and full power operating licenses for Diablo Canyon, Unit 1.
