Dear Judges Kelley,

Bright and Johnson:

Pursuant to the Board's March 5, 1985 Order, enclosed are copies of the Suffolk County and State of New York Reply Memorandum to NRC Staff and LILCO Responses Dated March 12, 1985. The County and Stato recognize that the enclosed Memorandum may be longer than the "brief reply" permitted by the March 5 Order. It was necessary, however, for the County and State to respond to the many misstatements of fact and erroneous conclusions of law argued by LILCO and the Staff in their March 12 filings.

Attached to the enclosed Memorandum is an affidavit from Assistant Chief Joseph L. Monteith, Deputy Chief Richard C.

Roberts, Inspector Philip McGuire, Deputy Inspector Michael J.

Turano, Jr., and Lieutenant Thomas P. Compitello of the suffolk County Police Department. In the view of the County and State, LILCO's persistent argument of factual matters in its March 12 filing necessitated attaching this affidavit to the enclosed reply Memorandum. The affidavit is being executed today on Long Island. The County and State will provide the Board and parties fully executed copies of the affidavit early next week.
