Gentlemen:

The " Graduated Rescission of Order dated August 15, 1979" and the gu'idelines (in the Appendix to the Graduated Rescission) defined a process for the controlled, stepwise resumption of activities at the Marble Hill site when certain prerequisites had been met.

Based on the inspection findings by Region III you have adequately implemented commitments made in response to the Order.

I have concluded that you have substantially accomplished the requirements of the " Graduated Rescission of the Order dated August 15, 1979," and have demonstrated that there is reason-able assurance that construction performance will be acceptable.

I have also concluded that the prerequisites necessary for the final rescission of the Order have been achieved.

Accordingly, the final rescission of the Order is hereby confirmed.
