Termination of Construction Pemits for Marble Hill Nuclear Generating Station, Units 1 and 2 On flovceber 3,1986, the presiding Atcmic Safety and Licensing Board issued a "Pencrandum and Order Terminating Operating License Proceeding" for Farble Hill Nuclear Generating Station, Units 1 and 2, without conditions on the termination of the proceeding.

Previously, on March 1,1985, you returned Construction Pennits CPPR-170 and CPPR-171 and indicated that Public Service Ccapany of Indiana, Inc., and Wabash Valley Power Association, Inc., the holders of Construction Pennits CPPR-170 and CPPR-171 no longer intend to construct nuclear pcwer reactors.

Since (a) no utilization facility has been constructed under Construction Permits CPPR-170 and CPPR-171; and (b) the holders of such Permits no longer intend to construct any utilization ft:ilities under the authority of these Permits; and (c) as indicated in the "Environn: ental Review Related to Public Service Company of Indiana's Request to Terminate the Harble Hill License Proceeding" prepared by the Division of Licensing dated February 20, 1986, the NRC staff is satisfied with the stabilization of the site; Construction Permits CPPR-170 and CPPR-171 are hereby tenninated.

The enclosed Order Tenainating Construction Pennits and Notice of Withdrawal of Application for Operating Licenses have been forwarded to the Office of the Federal Register for publication.
