Dear Mr. Keppler:

This is in response to NRC's Audit Report Number 83-15, dated September 13, 1983. The report identified one noncompliance to which the following will be addressed.

VIOLATION #1 - (FAILURE TO DOCUMENT A NONCONFORMANCE CONDITION)

A.

Description of Violation 10 CFR 50, Appendix B, Criterion XV, states in part, " Measures shall be established to control materials, parts, or components which do not conform to requirements... measures shall include, as appropriate, procedures for identification, documentation, segregation, disposition, and notification to the affected organization."

Marble Hill Safety Analysis Report, Section 17.1.15, states in part, "The following provisions are necessary for acceptance of principal contractor and contractor quality assurance programs by PSI:

(a) Control of the identification, documentation, segregation, review, disposition, and notification of affected organizations of nonconformance of materials, parts, components or services.

(b) Documentation identifies the noncon-forming items; describes the nonconformance, the disposition of the nonconformance."

Contrary to the above, the HVAC contractor identified a nonconforming condition - a linear indication on an I beam column located in the con-tainment at the 383' level at 16* 30' azimuth - but failed to document the noncompliance, or notify the licensee of the nonconformance and dis-position the nonconforming condition in accordance with procedural requirements.

Corrective Action Taken and Results Achieved The condition was identified on a Civil Contractor's Nonconformance Report (Newberg NCR-6375) and was dispositioned "use-as-is".

C.

Corrective Action which has been or will be taken to Avoid Further Noncompliance 1.

The HVAC contractor had verbally identified a possible noncon-forming condition. However, as indicated on the Civil Contractor's Nonconformance Report, this was not a nonconforming condition, and was dispositioned use-as-is.

However, in order to avoid future problems of this nature, Public Service Company of Indiana, Inc. (PSI) will issue a directive to Pullman Construction Industries and all other site contractors to emphasize during employee training their responsibil tty for reporting potential nonconformances outside their scope of work to PSI for resolution.

D.

Progress Achieved and Date of Full Compliance 1.

The Nonconformance Report (Newberg NCR-6375 has been dispositioned and is closed).
