Re: Turkey Point Units 3 8 4 Docket Nos. 50-250 Bc 50-25 I Emer enc Pre aredness Exercise Exem tion Re vest Florida Power 8c I ight Company requests an exemption from the annual exercise requirement of IO CFR 50, Appendix E,Section IV.F, as interpreted by NRC Information Notice No. 85-55: Revised Emergency Exercise Frequency Rule, with respect to the 1985 annual exercise for the'Turkey Point Plant. Our request consists of shifting the annual exercise into the early part of calendar year 1986, with subsequent exercises held during subsequent calendar years. For the upcoming exercise, all participants have agreed to an exercise date of January 22-23, I 986.

Our previous exemption request on this subject (FPL letter L-84-I89 from J. W.

Williams, Jr. to Harold R. Denton, dated July 26, l 984) changed the exercise date to a November time frame. Based upon previous interpretations of the definition of "annual", the Turkey Point exercise was set for January l 986. This date falls within a 9 to IS month window as provided in our Turkey Point Radiological Emergency Plan and was consistent with regulatory policy up until the issuance of IE Information Notice No. 85-55. We received a letter from Mr. Daniel G. McDonald of your Division of Licensing, dated May 9, I 985, regarding scheduling of emergency exercises, which supported the schedular change from November to January since all parties involved were in agreement and the date change met existing regulatory guidance.

The change into the early part of the l986 calendar year for the Turkey Point annual exercise has been agreed upon by state emergency preparedness officials.

Emergency management directors of Dade and Monroe Counties have determined that the Turkey Point exercise date will completely avoid the hurricane season thereby allowing their full attention as required by the demands of this period. We have determined that approval of this exemption request would not af feet emergency preparedness at Turkey Point; nor would it endanger life or property, the common defense and security or be contrary to the public interest. This request, therefore, complies with the requirements of IO CFR 50. I2 (Specific exemptions).
