Dear Mr. Collins:

This submittal provides an update to FPL's written notices, dated November 20, 1996 (L-96-310),

and June 27, 1997 (I 97-163), of a claim involving alleged bodily injury arising out of, or in connection with, the use of radioactive material at Turkey Point Units 3 and 4.

In the June 27 letter, FPL reported that the U.S. District Court for the Southern District of Florida dismissed the case filed by Mr. Bertram Roberts and Ms. Hanni Roberts against FPL. The Roberts's lawsuit, originally filed on October 10, 1995, in the Eleventh Judicial Circuit in and for Dade County, Florida, and later removed to the U.S. District Court for the Southern District of Florida, had alleged that Mr. Roberts contracted myelogenous leukemia as a result of his exposure to radiation while working at Turkey Point.

On July 22, 1998, the U.S. Court of Appeals for the Eleventh Circuit affirmed the District Court's decision dismissing the Roberts's lawsuit. Roberts v. FPL, 146 F.3d 1305 (11'" Cir. 1998). On February 22, 1999, the U.S. Supreme Court denied the Roberts's petition for a writ of certiorari, thus bringing this case to an end.
