1. INTRODUCTION This report presents the results of an evaluation of the licensee, Pacific Gas & Electric Company, in the functional area of licensing activities. It is intended to provide NRR's input to the SALP review process as described in NRC I4anual Chapter 0516. The review covers the period July 1,1981 to Decenber 31, 1982. liore than 90 percent of all licensing activities was associated with Unit 1.

The basic approach used for this evaluation was to first select a nunber of licensing issues which involved a significant anount of staff nanpower. Connents were then solicited frou the staff. In nost cases the staff applied the evaluation criteria for the per-fornance attributes based on their experience with the licensee or his products. Finally, this infornation was assenbled in a natrix

' which allowed an overall evaluation of the licensee's perfornance.

This evaluation is based on staff input fron five branches in three MRR divisions and from one branch fron the Division of Energency Preparedness, DIE.

II. Sunr.ary of Results NRC Manual Chapter 0516 specifies that each functional area evaluated will be assigned a perfornance category based on a conposite of a nunber of attributes. The single final rating should be tenpered with judgenent with respect to the significance of in.!ividual elenents.

Based on this approach, the perfornance of the Pacific Gas & Electric Company in the functional area - Licensing Activities - is rated category 2.

III. Criteria Evaluation criteria, as given in HRC Manual Chapter Appendix 0516 Table 1, uere used for this evaluation.

IV. Perfonsance Analysis The licensee's perfoniance evaluation is based on a consideration of seven attributes as given in the t.RC Hanual Chapter. For nost of the licensing actions considered in this evaluation, only three or four of the attributes were of significance. Thus, the c&.posite rating is heavily based on the following attributes:

- Managenent involvenent

- Approach to resolution of technical issues

- Responsiveness

- Staffing With the exception of Enforcement History, for which there stas.no basis within NRR for evaluation, the renaining attributes of

- Reportable events

- Training were judged to apply only to a few licensing activities.

The evaluation was based on our review of the following licensing activities:

- Equipnent Qualification

- Greakwater Structure

' - Control of Heavy Loads

- Operator Licensing

- Independent Design Verifcation Progran (IDVP)

- Energency P.esponse Capability ,

A. Managenent Involvenent in Assuring Quality The overall rating for this criterion is category 2. An exanale of nanager.ent involvement was their early connitment, en its own initiative, to postpone fuel loading upon discovery of the seismic discrepancies at the plant in Septenber 1981. Initial canagement involvement in the area of the design verification effort was linited, hovever subsequent nanagement attention has significantly increased.

Other areas where uaqaSenent involvenent was evident is its participation in equipment qualification and the breakwater repair where large allocation 11f resources were approved to undertake extensive breakwater model studies.

  • B. Approach to Resolution of Technical Issues fron a Safety Standpoint The overall rating for this criterion is category 1. There is consistent evidence of planning and assignaent of priorities; decision making is at a level that ensures nanagenent review. ,

C. Responsiveness For individual licensing actions exanined for this assessnent, category ratings varied from 1 to 3. The licensee peerformance in only one of the actions exanined was judged to fall into ,'

category 3 and that was in regard to control of heavy loads

In other areas the licensce's responsivenes.s is judged to be tinely with resolutions proposed usually acceptahle with little or no nod,1fication reouired. The overall rating is category 2.

D. Enforcenent History There is no basis for an NRR evaluation of this criterion.

E. Reportable Events

  • The overall rating for this Category is 2.

The Pacific Gas & Electric Conpany pro 7ptly notified the NRC on Septenber 28, 1981, prior to fuel ever being loaded into the core, of the seismic discrepancies found at the plant which resulted in license suspension and the initiation of the IDVP. LERs will be evaluated by the Diablo Canyon resident inspectors in accordance with 11r. T. Bishop's nenorandun dated January 21, 1933.

F. Staffing Category 1 is assigned based on a linited basis' for evaluation only.

The nunber of qualified plant operators exceed the number of operators required for full power operations of Diablo Canyon Unit 1.

G. Training The everall rating for this criterion is category 1. The licensee has a defined training progran for the station staff. With respect l

1 to the operator licensing orogram, four R0 and twenty three SRO examinacions were niven during the evaluation period with an overall passing rate of 81.5%. The Training Progran at Diablo Canyon is considered to provide a good understanding of work and adherence to procedures.

V. Conclusion Eased on the evaluation of the Pacific Gas a Electirc Company's perfornance for a number of significant activities in the functional area of ' licensing with respect to the seven criteria, an overall performance rating of category 2 is determined. Specifically, canagenent attention and involvenent with the resolution of natters of nuclear safety is evident by senior managenent participation in the IDVP.
