Request for Withholding Infonnation from Public Disclosure (CAW-85-079 and CAW 86-117)

By your applications dated September 22 and December 1,1986, you submitted Westinghouse Report No. WCAP-11269, " Westinghouse Setpoint Methodology for Protection Systems - Vogtle Station and its Revision 1, and requested they be withheld from public disclosure pursu?nt to 10 CFR 2.790. Also enclosed with your applications were affidavits from the Westinghouse Electric Corporation both dated December 2, 1976.

The affadavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

1. The document contains information which is customarily held in confidence by Westinghouse.

1 2. The information has been held in confidence by Westinghouse and is not available in public sources.

3. The information is the result of analyses perfonned by expenditure of considerable time and effort to Westinghouse.

We have reviewed your application and the material based on the requirements and criteria of 10 CFR 2.790 and on the basis of your statements, have deter-mined that the submitted information sought to be withheld contains trade secrets or proprietary comercial information.

Therefore, the Westinghouse Report No. WCAP-11269 and its Revision 1 marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of per-sons properly and directly concerned to inspect the documents'. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.
