Request for Withholding Infonnation from Public Disclosure (CAW-84-23 and CAW-85-031)

By its applications dated April 27, 1984, and ipril 16, 1985, Georgia Power Company submitted responses to Question 491.2 and Draft Safety Evaluation '

Report Open Item 71 and requested that they be withheld from public dis-closure pursuant to 10 CFR 2.790. Also enclosed were affidavits from the Westinghouse Electric Corporation dated May 12, 1976 and November 28, 1979, respectively.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

1. The document contains information which is customarily held in confidence by Westinghouse.
2. The infonnation has been held in confidence by Westinghouse and is not available in public sources.
3. The information is the result of analyses performed by expenditure of I considerable time and effort to Westinghouse.

We have reviewed your applications and the material based on the requirements and criteria of 10 CFR 2.790 and on the basis of your statements, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

Therefore, the above named information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

Withholding from public inspection shall not affect the right, if any, of per-sons properly and directly concerned to inspect the documents. If the need >

arises, we may send copies of this information to our consultants working in this area. We will, of course, insure that the consultants have sicnec the appropriate agreements for handling proprietary information.
