Dear Judge Smith:

I .am writing to advise you and the other Board members and the parties of a matter in the United States District Court for the Southern District of Texas which will require me.to travel to Houston on October 8, 1987 and' appear in court on October 9. I am unable to arrange a substitute for the hearing-in Houston since I.have been named as a defendant. I have been sued personally-even though the conduct at issue was part of my official duties as attorney for the Federal Emergency Management Agency (FEMA).

I am making arrangements for another attorney from FEMA to fill in for me on October 8 and 9.. A Notice of Appearance for William R. Cumming is enclosed. I fully understand that the hearing on the Offsite Emergency Planning is very significant to all of the parties and the logistics of rescheduling a hearing with so many parties are forbidding, and so I am not-requesting a postponement or suspension of the hearing. However, it would be convenient if FEMA witnesses were not' called on October 8 and 9.

I will appreciate whatever accomadation can be made. 1 i
