C. 20555 Dent Chairman Zech: Re: Roopening Pilgrim Lowpower License for Seabrook In my letter of February 10, 1988 regarding Sirens at Seabrook I urged you to take action to limit the interference of the State of Massachusetts in the FEDERAL 11uclear Regulatory orocess.

The history of problems between states and the battles over states rights goes back to the days of the ratification of the Constitution in 1789. In fact the Federalists were only able to achieve ratification by the State of New Hampshire because of the then problems between the States of Massachusetts and New Hamoshire.

'Ihere can be no question that the Federal Government has haen designated by Congress to regulate the generation of Nuclear Dower.

The Governor of Massachusetts has again, this week, threatened to challenge the Federal Authority in Court. In the report in the Boston Globe written by Larry Tye 10/13/88, however, both opponents of the Plymouth Reactor and Plant Owners "agreed that a legal challenge IS LIKELY TO FAIL, and that the suit would serve" largely pol.itical ends.

By this letter we urge you to proceed immediately on bota fronts to establish the v e doral Supremacy in this matter, to relicense Pilgrim, and to excedite the operation of Seabrook.

While you may earn the criticism of the present known critics of the Nuclear processes, you will shottiv carn the congratulations of far greater numbers of citizens by Istooping the challenges to the Nuclear Regulatory Commission.

As I said in February, "any lesser action could be interpreted by the oublic as a successful challenge of a Federal Regulatory Commission by a losser autht.gity.
