Dear Ms. Varricchio:

This is in response to your undated letter, which was received in this office on September 7, 1984, in which you requested, pursuant to the Freedom of Information Act (F0IA), all records regarding the Nuclear Regulatory Commission's (NRC) Region IV audit (Inspection Report) at'the Wolf Creek Generating Station of several on-site Kansas Gas and Electric offices. You indicated this includes the personnel and security offices of KG&E on or about August 30, 1984. In a telephone conversation on September 14, 1984, with Mrs. Pappas, of my staff, you clarified your request by indicating you wanted all records that pertain to the August 30, 1984, audit.

Also, in a telephone conversation on October 18, 1984, with Mrs. Pappas, you agreed to wait for the final sanitized version of the Inspection Report 50-482/84-21.

The documents listed on the enclosed Appendix A are responsive to your request and are being placed in the NRC Public Document Room (PDR), 1717 H Street, NW, Vashington, DC 20555. You may obtain access to these records by presenting a copy of this letter to the PDR staff or by requesting F0IA folder F01A-84-723 under your name.

Portions of the documents listed on the enclosed Appendix B and all of the documents listed on the enclosed Appendix C are being withheld from public disclosure based upon the FOIA evenptions noted ne)t te each dccument. The nonexempt portions of the documents identified at Appendix B are being placed in the PDR in F01A fclder 84-723.

Information withheld pursuant to Exemption (3) consists of unclassified safeguards infomation. The statutory authority for withholding this information is found in Section 147 of the Atomic Energy Act (42 U.S.C.

2167). This information is being withheld frorr public disclosure pursuant to Exemption (3) of the F0IA (5 U.S.C. 552(b)(3)) and 10 CFR 9.5(a)(3) of the Comission's regulations.

Infonnation withheld pursuant to Exemption (4) identifies procedures for safeguarding licensed special nuclear material at a licensed facility or plant. This information is considered comercial or financial (proprietary) information pursuant to 10 CFR 2.790(d) and is being withheld from public disclosure pursuant to Exemption (4) of the FOIA (5 U.S.C. 55?(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.

Information withheld pursuant to Exemption (6) consists of names and other identifying information on individuals, the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. This in-formation is being withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Comission's regulations.

Pursuant to 10 CFR 9.9 of the NRC's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the undersigned and Mr. Robert D. Martin, Administrator, Region IV.

This denial may be appealed to the NRC's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFP 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Comission, Washington, DC 70555, and should clearly state on the envelope ar.d in the letter that it is en "Appeel from an Initial F0IA Decision."
