Dear Ms. Stephens:
This is in response to your letter dated August 20, 1985, in which you requested, pursuant to the Freedom of Information Act (F0IA), copies of documents within the Office of Investigations' (01) case files regarding investigations which have occurred within the time frame May 1,1985, and the date of receipt of your request, August 27, 1985.
The documents identified on enclosed Appendix A, contained in 01 file Q4-85-007, and the documents identified on enclosed Appendix B are being released in whole or in part. The F0IA exemption is indicated beside each document description.
One OI investigation is ongoing, and documents contained in three other 01 case files relate to the ongoing investigation. These investigations are listed on enclosed Appendix C, and are being withheld in their entirety pursuant to Exemption 7(A).
Information being withheld pursuant to Exemption (7)(A) consists of investigatory records compiled for law enforcement purposes the release a

of which would interfere with an ongoing enforcement proceeding. Release of this information could allow those being investigated to learn the scope, direction, and focus of investigatory efforts, and thus could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators. This infonnation is being withheld from public disclosure pursuant to Exemption (7)(A) of the F0IA, 5 U.S.C. 552(b)(7)(A), and 10 CFR 9.5(a)(7)(1) of the Commission's regulations.
Information being deleted pursuant to Exemptions (6) and (7)(C) contains personal privacy information the disclosure of which would constitute a clearly unwarranted invasion of personal privacy. This information is being withheld pursuant to Exemptions (6) and (7)(C) of the F0IA, 5 U.S.C.
552(b)(6) and (7)(C), and 10 CFR 9.5(a)(6) and (7)(111) of the Commission's regulations.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined i
that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Ben B. Hayes, Director, 01.

This denial may be appealed to the Secretary of the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
In light of this response, we are taking no further action on your letter dated March 18, 1986, appealing our lack of response to your request.
