January 5, 1984 Harold R. Denton, Director Office .of Nuclear Reactor Regulation Nuclear Regulatory Commission Washington,.D.C. -20555 Re: Operating License Antitrust Review--

Perry Nuclear Plant, Unit 1

Dear Mr. Denton:

Under date of December 6, 1983, a copy of the finding of the Director of Nuclear Reactor Regulation as well as a copy of;the. staff analysis pertaining to Unit 1 of the Perry Nuclear Plant was forwarded to Mr. Joseph Pandy, Jr. , Commissioner of Cleveland Public Power (formerly Division of Light and Power of the. Department of Public Utilities), in light of the City of Cleveland's interest in the above-captioned proceeding.

. The findings of the Director and the staff analysis are under study by. counsel.for the City of Cleveland and other per-sonnel of Cleveland Public Power.- The City of Cleveland has not yet determined whether because of pending matters with Cleveland Electric Illuminating Company the Director's finding should be the subject of a request for reconsideration or a request for the issuance of a Notice of Violation to enforce the license condi-tions and the request for civil penalties that are discussed in the staff analysis. The City of Cleveland's counsel and person-nel need more time to assemble and evaluate relevant facts in order to make that. determination.

Therefore, the City of Cleveland requests an extension of thirty days'within which to complete its study and to respond to the Director's finding.

Very truly yours, b $O " N Y ~ hp /ftfy Reuben Goldber
