Docket Nos. 50-440 and 50-441 D

Dear Members of the Appeal Board:

Enclosed for your information is a recent news release by the State of Ohio Department of Health announcing the State's policy on the distribution of potassium iodide. Issue 1(G) in this proceeding contended that emergency plans should include the availability of potassium iodide for emergency workers and the public. The Licensing Board granted summary disposition on this contention, based on the deference given to state and local guidance on this matter and the absence of any regulatory requirement for the distribution of potassium iodide. See Memorandum and Order (Motions)(ASLBP No. 81-457-04 OL)(March 13, 1985) at 1; Memorandum and Order =(Motions for Summary Disposition of Issues 1, 15 and 16)(ASLBP No. 81-457-04-OL)

(April 9, 1985) at 4-5.
