i Messrs. Rosenthal, Reed and Wilber December 12, 1985 Page Two ASLB's-Concluding Partial Initial Decision ("PID"). The footnote in question addresses a defect with crankshaft oil hole plugs at another facility, and states that the ASLB did not characterize the defect as a failure, citing PID at 65.

The ASLB did, however, in its Findings of Fact, label the potential defect as a " failure." See id. at 112 (Finding 170).

The' testimony cited by the ASLB, as well as by Applicants in their brief, indicated that the potential defect involved a crack in the plug, rather than a complete' failure. See Tr.

2263 (Christiansen), Tr. 2230 (Kammeyer). The nature of the characterization does not in any way affect the conclusions of the ASLB or the arguments in Applicants' Brief.
