Dear Ms. Nesbit:

I As requested in your letter to Mr. Jay Traverso dated September 25, 1992, enclosed is a copy of the signed Return to Generator Manifest and a copy of the signed Lc.nd Disposal Restriction form for the shipment and disposal of the six (6) drums of mixed solvent and radioactive wacte. We are also providing additional information to help clarify some of the issues raised in your September 25th letter. For clarity, we first set forth and underlined your comments, then provided our response.

I. Findinc of Fact Made by OEPA A. Durino the May 29, 1991 RCRA insoection conducted by Nancy Zilananis.

Marlene Emanuelson and Karen NesDit. PNPP stated enat enere was no mixec waste cenerated or stored at the facility. PNPP reolied to the incuiry tnaIcurina a June 1992 survev orTue oil storage area, crums contaminated witn Cocalt 60. Stoccard solvents and acetone ,

were round.

CEI personnel present during the May. 29, 1991 RCRA inspection stated that PNPP no longer generated a radicactively contaminated freon mixture due to the discontinuation of the use of freon as a degreasing or dry-cleaning agent at the f acility. CEI personnel believed that at that time we were not generating or storing any cther mixed waste streams. The six barrels of mixed waste discussed here were discovered by CEI personnel during a June 1992 survey of the Plant, However, we recogni:e that the potential still remains for the generation of mixed waste frcm other sources within the plant.

13 . P!JPP is also actively generating a mixed waste stream which was ,

.previously sent to Northeast Chemical.

CEI would like to clarify this statement. The waste streams we have sent to NEC have been tested and classified as hazardous waste,.not  ;

a mixed waste. We do generate waste solvents which have the  :

potential to be radioactively contaminated. These materials will'be tested and sent.to 'rSDF's licensed to handle radioactive material.

Non-radioactive hazardous waste streams will continue to be sent to TSD' facilities.

C. P11PP claims that this waste (sic) contained levels of radioactive material which until-recently was considered non-radioactive by the ,

fluclear Regulatory Commission (!!RC). According to Pf1PP the llRC had informed P!JPP that the environmental lower level of detection (LLD) 3 should be used instead of the effluent LLD which was previously.

being used to classify wastes as either radioactive or  ;

nonradioactive. This change now gives that spent solvents a mixed i waste classification even though P!JPP claims that th: levels are  ;

below the etfluent LLD.

The change from effluent to environmental levels.did not change the classification of the six barrels of mixed solvents at issue. The

solvent material stored on-site was known to be radioactively contaminated and labeled as such upon their generation. The solvents were not recognized as hazardous until June of 1992. At that time, the materia' was classified as mixed waste.

The PNPP has always followed industry acceptable practices in the l

release of material from the radiologically restricted area.

II. Conclusionr of Law Made by OEPA A. PflPP is in violation of the Ohio Revised Code 3734.02 (E) and (F).

PNPP stored a hazardous waste for greater than 90 days at a tacility without a permit and established a hazardous waste facility without first obtaining a permit. This is also a violation of the Ohio i~ Administrative Code- 3745-52-34.

obtain a permit for the hazardous waste generated on-site based on-guidance provided in the August 29, 1991 Federal Register. ,

In 1991, the Company secured a contract with Diversified Scientific Services, Inc. (DSSI) in Kingston, Tennessee for the treatment and disposal of mixed waste from PNPP. As stated during your September 1, 1992 inspection, the Company justifiably relied on the ability to ship such material to DSSI and, thus did not submit a Part A permit application.

In early August, 1992, when the DSSI facility experienced technical problems and could no longer accept PNPP mixed waste on schedule, our inability to technically comply with ORC 3734.02 (e) and {F); our reliance on the August 29, 1991 EPA Policy Statement; cnd our failure to identify that the four containers of mixed waste ex,eeded the storage limitations in OAC 3?45-52-34, have resulted in the violation identified during your inspection.

B. The Policy on Enforcement of RCRA S6ction 3004 (J) . Storage Prohibition at Facilities- Gent ; tina Mixed hadioactive/ Hazardous  !

Waste (56 Fed. Reg. 42'130) (Aug. 29[ 1991), which PNPP believed 1 exempted it from storage permit requirement does not apply to FNPP for three reasons:

1. The policy was intended to apply to permitted treatment, storage and ,

disposal facilities iTSDF).

CEI's interpretation of the subject policy statement is that it is .

Intended to relieve all generators of mixed waste (less than 1,000 cubic feet per year) from enforcement. liability for violations of the storage prohibition applicable to land banned mixed waste.

2. The policy explicitly nt;tes that it *does not affect any '

requirements under RcPA to obtain ,a_ storage permit."

We agree-with this statement, and after conferring with. legal counsel and other generators of mixed wsste, recognize that the Policy does not affect the EPA's authority to enforce all other regulatory

- requirements under PCRA, including permitting and hazardous vaste management requirements. Because of the confusion surrounding the extent of relief af forded mixed waste generators by the Policy.

Statement; the regulatory dilemmas created by the dual regulation of mixed waste; and the lack of qualified mixed waste treatment and disposal capacity, CEI, along with other utility mixed waste generators, is supporting a Petition for Rulemaking filed on January 13, 1992 by the Utility Solid Waste Activities Group-(USWAG) aimed atL alleviating the uncertainties associated with mixed waste management,

3. Ohio has been authorized by U.S. EPA to implement mixed vaste programs and the Policy is not binding on Ohio.

CEI interprets f ederal and state hazardous vaste laws to require that state implem ne programs te substantialir equivalent to the federal progren. Ve continue to believe that the Policy Statement is in effect for all enforcement activities in authorized states, such as Ohio, vhich have not yet received authorization for the land disposal program. Because Ohio is not yet authori> -d to administer third-third land disposal restrictions, we believe that the U.S. EPA is the enf orcement authority in Ohio for land disposal restrictions and this Policy is, therefore, binding on it.

CEI has used *his response to further explain the regulatory uncer tainties f acing mixed generators and to demonst rate our good f aith '

efforts at PUPP to comply with Ohio's hazardous and mixed vaste '

requirements. As a result of the_ September 1, 1992 inspection, ve have increased our efforts to eliminate the use of materials that could create a mixed vaste by introducing nonhazardous citernatives in the radiologically restricted area of the plant, and we are improving our program governing the irpeditious sampling and identification of vaste at its point of generation.

PNPP vould like to emphasize that at no time, was there a threat to human health or the environment as a result of the vaste generation or storage practices at Perry.
