ne Perry Nuclear Power Plant (PNPP), currently holds Authorization to Discharge, Lake County Department of Utilities Pennit Number 1004911, effective 9/1/94 and expiring 9/l'99. Please remove PNPP from the Significant Industrial User list for Lake County and terminate the existing permit. PNPP does not meet the definition for a significant industrial user, as stated in 40 CFR 403.3(t). 40 CFR 403.3 defines a significant industrial user as a facility that either discharges an average of 25,000 gallons per day of process wastewater, or " contributes a process wastestream which makes up 5 percent or more of the average dry weatherhydraulic or organic capacity of the POTW"(Publicly Owned Treatment Works). The sanitary sewage discharge leaving PNPP is made up of wastewater from kitchens and bathrooms. Since industrial process water is not discharged to the sanitary sewer system, PNPP does not satisfy the definition of significant industrial user.

PNPP presents no reasonable potential for adversely affecting the POTW operation. PNPP records indicate that PNPP was classified a significant industrial user in 1991, based on discharge volume. From receipt of j

the permit, PNPP has filed quarterly reports summarizing monthly sampling and analysis. The . >

unscheduled monitoring by Lake County has also been performed. During this time, only two violations occurred. Both incidents have been addressed and corrected.

Since PNPP does not meet the definition of significant industrial user and presents no reasonable potential for adverse effect on the POTW, please terminate permit number 1004911. Sanitary sewage from kitchens and bathrooms will still continue to be routed to the LCDU. {- O()/
