Dear Mr. Gabriel:

j I have been requested to respond to your letter of. August 10,'1987, to I Chairman Lando W. Zech Jr. as well as your telephone call with a member of our staff regarding the operation of the Seabrook Nuclear Power Station, Unit 1.

Specifically you request that the Public Service Company of New Hampshire (PSNH) be allowed to operate the facility at 5 percent power while awaiting approval of 1 an evacuation plan.

Currently, PSNH has a license to load fuel in Unit 1, and to run precritical tests. j PSNH is seeking to obtain a license to operate the plant up to 5 percent power {

and to perform certain startup tests prior to obtaining a full power operating 1 license that will permit PSNH to commercially operate the nuclear plant to i generate power.

To obtain a 5 percent power license, PSNH is requDed to submit to the Commission a bona fide utility emergency preparedness plan triat' covers the Massachusetts portion of tne Seabrook plant's emergency planning zone (EPZ). PSNH has indicated it will submit such a plan in mid-September 1987. The Commission will consider the plan along with any commsnts the Commission may receive from parties to the Seabrook proceedings. If the Commission renders a decision favorable to l PSNH, the Commission could authorize the issuance of a 5 percent power license.

To authorize issuance of a full power license, a number of matters have to be completed. Hearings on the New Hampshire emergency preparedness plan must be held by the Atomic Safety and Licensing Board (ASLB). These hearings are scheduled to begin on September 28, 1987 and will probably take a number of months to complete. In addition, the PSNH emergency plan for Massachusetts must be reviewed by the Federal Emergency Management Agency and the NRC, and it may also be the subject of litigation before the ASLB. This review and litiga-tion must be completed, with findings favorable to PSNH, before a full power license can be issued.

In summary, there are a number of PSNH actions and regulatory approvals required before the Seabrook plant can be granted a full power operating license. I trust that this information is responsive to your request.
