Dear Ms. Curran and Messrs. Dignan and Berry:
The Appeal Board is now in receipt of the applicants' brief in opposition to the appeal of the New England Coalition on Nuclear Pollution from the Licensing Board's August 8, 1988 memorandum and order in the onsite emergency
(
planning and safety issues phase of this proceeding.
Because the Coalition's brief in support of its appeal was filed and served by regular mail on September 23 (the thirtieth day following its notice of appeal), the NRC staff's responsive brief must be filed no later than November 7, 1988.
10 CFR 2.762(c), 2.710.
Pending receipt of the staff's brief, the Appeal Board is deferring its determination respecting the advisability of an oral argument on the appeal.
Because the Board believes that an expeditious disposition of the appeal is warranted, if held the argument will take place at 10:30 a.m. on Thursday, November 17, 1988 in Bethesda.
The staff's brief should be in the hands of the members of the Board no later than the morning of November 8.
Promptly following its receipt and examination, the parties will be notified by telephone whether oral argument will be heard.
If the Board's determination in that regard is in the affirmative, the parties will also be provided with such r
details as time allotments.
A confirmatory scheduling order will issue shrrtly thereafter.
