This refers to our request for records in your possession relative to the suspension, termination or discipline of security officers employed by you at the Big Rock Point Nuclear Power Plant operated by Consumers Power Company in Charlevoix, Michigan. We requested to review these personnel records on February 19, 1986 and you agreed on February 24, 1986 to produce the records for our review. We are requesting the records pursuant to a review of allegations or complaints made regarding compliance with security plan commitments and other applicable regulatory requirements.

On February 24, 1986, we provided a member of your staff the relevant sections of the Atomic Energy Act of 1954, as amended, and Title 10, Code of Federal Regulations that describe our authority for requesting the infomation and our

' responsibilities regarding the protection of information exempt from public disclosure as defined by the Freedom of Information Act and implemented in 10 CFR 9.5(a)(6). Later, on February 24, 1986, during a telephone conversation with.my staff you agreed that our request was in accordance with Section 17.62(a) [ Exclusivity] of the Michigan Statute known as the "Bullard -

Plawecki Employment Right to Know Act" (SLL 32:204), which provides that the section precluding disclosure of disciplinary infomation shall not apply if the information is requested by a government agency as a result of a claim or complaint by an employee, and that you would produce the records for our review.

On February 25, 1986, arrangements were made with your staff for the review of those records during the week of March 3,1986, and would include records of suspensions, terminations, reprimands or other disciplinary actions for current or fomer security officers employed at the Big Rock Point facility for the specific period of January 1, 1984 to February 24, 1986. These will be the official Burns' records which document the names, circumstances, and 4

your review or investigation of those suspensions, terminations, reprimands, or other disciplinary actions.
