NEED TO CHANGE BASIS FOR REQUEST FOR EXEMPTION FROM CERTAIN PHYSICAL PROTECTION REQUIREMENTS (10 CFR PART 73) - BIG ROCK POINT NUCLEAR PLANT (TAC NO. MA4240)

The staff has received your request for exemption from various 10 CFR Part 73 physical protection requirements dated November 12,1998. However, your exemption request was improperly based on the requirements of 10 CFR 50.12 instead of the applicable requirements of 10 CFR 73.5. Therefore, you must resubmit your exemption request in accordance with 10 CFR 73.5, " Specific exemptions," in order for the staff to complete its review and for the Commission to approve your request. l l

Nonetheless, we continue our review of your proposed exemption. We also plan on publishing our environmental assessment for this action by the end of January 1999.
