CONSUMER'S REQUEST FOR EXEMPTION FROM CERTAIN REQUIREMENTS OF 10 CFR 50.54, CONDITIONS OF LICENSE (TAC No. MA1009)

Dear Mr. Powers:

On February 19,1998, you requested exemptien from certain requirements of 10 CFR 50.54, " Condition of licenses," based on, in part, your determination that the Big Rock Point (BRP) Nuclear Plant is permanently shut down and defueled. In particular, you requested exemption from 10 CFR 50.54(i)(i-1), (j), (k), (I), and (m). You also provided your justification as to why Senior Licensed Operators and Licensed Operators are no longer required at the BRP facility.

Our staff has reviewed your request for exemption and concluded that exemption from the requested requirements is not required. Consumers has certified the permanent cessation of power operations and defueled status of the BRP facility in accordance with 10 CFR 50.82(a)(1). As a result, the 10 CFR Part 50 license (DPR-6) assigned to the BRP facility no longer authorizes operation of the reactor or emplacement of fuelinto or retention of fuel in the reactor vessel (10 CFR 50.82(a)(2)). Therefore, there is no control at the BRP facility tha: when manipulated would result in a change of reactivity or power level in the reactor and individuals at the BRP facility need not be licensed by the Commission as operators.

In summary, operator licenses in accordance with 10 CFR Part 55 are not required at the BRP facility and the regulations pertaining to licensed operators are no longer applicable; these regulations include 10 CFR 50.54(i), (i-1), (j), (k), (l) and (m). The NRC staff has l
