EXEMPTION FROM CERTAIN PHYSICAL PROTECTION REQUIREMENTS (10 CFR PART 73) - BIG ROCK POINT NUCLEAR PLANT (TAC NO. MA4240)

Dear Mr. Powers:

The U.S. Nuclear Regulatory Commission has granted the enclosed exemption from certain requirements of 10 CFR Part 73, to allow the implementation of a safeguards contingency plan reflecting the permanent shutdown and defueled condition of the Big Rock Point Nuclear Plant, in response to your letter dated November 12,1998, as supplemented by letter dated January 12,1999. 1 This exemption is authorized by law and will n ndanger life or property or the common defense and security, and is otherwise in the ublic interest (10 CFR 73.5).

The exemption has been forwarded to the Office of the Federal Register for publication. A copy of the exemption is enclosed. The staff's Safety Evaluation will be sent by separate correspondence.
