REGARDING OFFSITE EMERGENCY PLANNING ACTIVITIES AT BIG ROCK POINT NUCLEAR PLANT AND APPROVAL OF DEFUELED EMERGENCY PLAN (TAC NOS. M99688 AND M99689)

Dear Mr. Powers:

The Commission has issued the enclosed exemption from 10 CFR 50.54(c) for the Big Rock Point (BRP) Nuclear Plant in response to your application letter dated September 19,1997, as supplemented or modified by letters dated October 29, November 20,1997,and March 2, April 29, July 30, and August 28,1998, in which you requested exemption from certain portions of 10 CFR 50.47(b) and Appendix E to 10 CFR Part 50 to allow BRP to discontinue offsite emergency planning activities and reduce the scope of onsite emergency planning as a result of its permanently shutdown and defueled status. The specific requirements from which exemption is granted are listed in the enclosed Safety Evaluation for Exemption. Also enclosed is a copy of the Environmental Assessment and Finding of No Significant impact related to your exemption application.

The staff has also completed its review of the BRP Defueled Emergency Plan (DEP) as submitted, supplemented, and modified by the letters noted above and has approved it subject to your commitment to revise your DEP, as discussed in the enclosed Safety Evatuation for the DEP, prior to its implementation.
