. DGCKET 50-155 - LICENSE DPR BIG ROCK POINT PLANT: WITHDRAWAL AND l CIIANGE OF CERTAIN PORTIONS OF PROPOSED AMENDMENT REQUEST DATED l SEPTEMBER 19,1997.

l The purpose of this letter is to request withdrawal of certain sections of an Amendment request that was forwarded to the Commission by letter dated September 19,1997, as supplemented by letters dated June 5, July 21, and October 14, 1998. The Big Rock Point staff also proposes to retain certain sections of the Current Technical Specifications (CTS) and proposes several other changes to support this withdrawal request. This action is necessary based on discussions and conclusions reached between the NRC and Big Rock Point staffs. Where appropriate, the NRC Staff has also proposed and Consumers Energy has agreed to certain editorial changes to be included in the final amendment.

The following proposed Defueled Technical Specifications (DTS) sections are withdrawn and/or ,

revised: l

1. DTS 3/4.1.3.c and DTS Bases 3.1.3.c 1

Withdraw DTS 3/4.1.3.c and DTS Bases 3.1.3.c in their entirety. Revise DTS 3.1.3,

" ACTION," as shown below, to reflect the proposed deletion of DTS 3/4.1.3.c. The requirement to store spent fuel with a decay time of greater than one year in the outer three rows of the fuel rack adjacent to the south wall of the spent fuel pool ensured that the radiological fields would be minimized during periods of reactor defueling . The south wall provides the least amount of shielding with respect to the thickness of the other Spent Fuel Pool walls. Since all the fuel has been cooling for over 400 'hys, and the reactor has been permanently defueled, this requirement no longer has ruerit. The intent of the requirement is inherently met based on the age of the fuel assemblies.

ACTION: "With the requirements of Specifications 3.1.3.a or 3.1.3.b not met..

2. DTS 6.6.1.1

. Revise 6.6.1.1 as follows, adding " Quality Program Description (CPC-2A); and," as DTS 6.1.1.c and replacing " Site" with "Defueled" as used in DTS 6.6.1.1.a and b. The " Quality Program Description" was added to be consistent with other permanently defueled plant's technical specifications. "Defueled" was inserted in place of " Site" for administrative consistency in the facility's documents. Security Plan and Emergency Plan have also been capitalized to indicate that these documents are programs,

a. Defueled Security Plan;
b. Defueled Emergency Plan; .
c. Quality Program Description (CPC-2A); and "
d. All programs listed in Specification 6.6.2.
3. DTS 6.6.2.2.1 Add the phrase "or equal to" prior to "1000 Millirem per Hour" as used in the title and prior to "1000 mrem /hr" as used in the first sentence to correspond with 10 CFR 20.1003.
4. DTS 6.6.2.2.1.b Withdraw DTS 6.6.2.2.1.b in its entirety and retain CTS 6.12.1.b as DTS 6.6.2.2.1.b, as follows:

"A radiation monitoring device which continuously integrates the radiation dose re.te in the area and alarms when a preset integrated dose is receved. Entry into such areas may be made after the dose rate levels in the area have been established and personnel have been made knowledgeable of them, or "

5. DTS 6.6.2.2.2.  ;

i Withdraw the phrase "or equal to" as used in the title prior to "1000 Millirem per Hour" and as used in the first sentence prior to "1000 mrem /hr at 30 cm."

Withdraw the sentence "[t]he dose rate levels in the immediate work areas and the maximum allowable stay time for individuals in that area shall be conununicated to the individuals," as used in the first paragraph. Retain the applicable CTS 6.12.2 wording, as follows:

...which shall specify the dese rete levels in the immediate work areas and the maximum stay time for individuals in that area."

6. DTS 6.6.2.5.g Withdraw DTS 6.6.2.5.g in its entirety. Retain CTS 13.1.3.1 as DTS 6.6.2.5.g, as follows, and change " Figure 2.1" to " Figure 5.1-1" and delete reference to iodine dose rate monitoring, because more than 10 iodine half lives have occurred since reactor shutdown.

"The dose rate due to radioactive materials released in gaseous effluents from the site to areas at or beyond the site boundary (see Figure 5.1-1) shall be limited to the following:

(a) For noble gases: Less than or equal to 500 mrems/hr to the total body and less than or equal to 3000 mrems/yr to the skin, and (b) For tritium and for all radionuclides in particulate form with half lives greater than 8 days: Less than or equal to 1500 mrems/yr to any organ."

7. DTS 6.6.2.5.j Withdraw the proposed deletion of CTS 13.1.4.3. Retain CTS 13.1.4.3 as DTS 6.6.2.5.j as follows, and delete reference to iodine dose requirements, because more than 10 iodine half lives have occurred since reactor shutdown.

"The dose to a member of the public from tritium and all radionuclides in particulate form with half lives greater than 8 days in gaseous effluents released to areas at or beyond the site boundary (see Figure 5.1-1) shall be limited to the following:

(a) During any calender quarter: Less than or equal to 7.5 mrems to any organ, and (b) During any calender year: Less than or equal to 15 mrems to any organ."

The changes proposed above and the changes proposed in submittals dated June 5, July 21 and October 14, 1998, do not result in a change to the significant hazards consideration that was previously submitted as a part of the original amendment request.
