Dear Mr. Stratman:

This refers to the inspection conducted by Messrs. A. Vegel, E. Duncan, and

1 Hopkins of this office on November 21 through December 28, 1992. The

inspection included a review of activities authorized for your Perry Nuclear

Pe.wer Plant, _ Unit 1, f acility. At the conclusion of the inspection, the-

findings were discussed with those members of your staff identified in the

enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). Violations #1 and #2 are of concern because a

contributing causal factor in these events was personnel error. The issue of

i personnel errors is of continued concern due to past problems in this area.

Concerning violation #3, although we have noted an improvement in the

chanliness of some areas of the Perry plant, including the Division 11 and

l

11! diesel generator rooms, the overall general-cleanliness condition of the

plant continues to be of concern.

Durug this inspection, two additional items appeared to be in violation of

,

NRC requirements. However, as described in the enclosed inspection report,

L you identified these violations. Therefore, the violations will not be

l

subject to enforcement action because your efforts in identifying and

l correcting the violations meet the criteria specified in Section VII.B of the

l- "Gerioral Statement of Policy and Procedure for NRC Enforcement Actions,"

(Enforcement Policy, 10 CFR Part 2, Appendix C (1992)).

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your

response, you should document the specific actions taken and any additional

actions you plan to prevent recurrence. With respect to Violations #1 and #2,

we recognize that your corrective actions for these specific problems were

documented in their respectise Licensee Event Reports (LERs). We do not

require any additional information with respect to those specific items. We

do however request that you include in your response a summary of your overall

corrective action program to reduce personnel errors, your timetable for full

implementation, and the status of your progress towards achieving this

timetable. You are also requested to specifically address in your response to

the Notice what actions will be taken to improve and sustain plant

cleanliness. After reviewing your response to this Notice, including your

proposed corrective actions and the results of future inspections, the NRC

will determine whether further NRC enforcement action is necessary to ensure

compliance with NRC regulatory requirements.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of

this letter, the enclosures, and your response to this letter will be placed

in the NRC Public Document Room.

The responses directed by this letter and the accompanying Notice are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Reduction Act of 1980, PL 96-511.
