Dear Mr. Cain:

Your letter of February 1G,1984, to Chairman Palladino has been referred to me for response.

I can understand your concern with early identification of allegations. We share this concern.

I can assure you that, consistent with our overall health and safety responsibilities, the NRC staff will continue to apply resources to the followup of these issues to minimize the impact on your staff and schedule.

However, the NRC has the responsibility to ensure that allegations made to the NRC are handled in a manner that does not compromise confidentiality or an ongoing inspction/ investigation.

The 237.page sworn statement relating to the Gambit articles, which you referenced in your letter, is being reviewed by the NRC staff and is part of an ongoing inspection / investigation.

For this reason, we are withholding this statement at this time.

However, this does not preclude LP&L Company from conducting their own interviews.

Indeed, we encourage your independent investigation of the matter.

If you so desire, I would encourage you to discuss this matter further with John T. Collins, Regional Administrator, Region IV.
