Dear Ms. Curran:

In our telephone conversation on Noverber 2,1983, you indicated that in our response to Interrogatory la, we had respanded to the incorrect version of NECNP Contention 10. In that same conversaticn you agreed to limit the scope of Interrogatory 2. In accordance with your letter of November 7,1983 (copy attached) limiting the scope of Interrogatory 2, we have responded.

With regard to your m3ving to cmply FEMA to respond, as I indicated in my letter of October 20,.1983, th.is Agency is not a party to the pro-ceeding and is not required to respond to interrogatories served under 10 C.F.R. S 2.740b or produce documents under 10 C.F.R. S 2.741.

Dear Brian:

This is to confirm our telephone conversation last week about FEMA's objection to NECNP interrogatory 2. The interrogatory asks for all documents relating to the New Hampshire Radiological Emergency Response Plan. As I explained, we are interested in obtaining any internal documents or correspondence containing analysis, evaluation, or substantially detailed discussion of the New Hampshire RERP as it relates to Seabrook. We are not interested in documents we already have, or documents which only mention the plan in passing. In our conversation, you agreed to answer the interrogatory under this more narrow construction.

Because we have reached an agreement on Interrogatory 2, NECNP will not be filing a motion to compel with the Licensing Board. Therefore, please let me know as soon as possible if you do not share our understanding of this agreement. Thank you for your cooperation.,
