In the Matter of Public Service Company, et al. (Seabrook Units 1 and 2) Docket Nos. 50-443 OL & 50-444 OL
Dear Diane:
Enclosed are the State of New Hampshire's Ancwers to NECNP's Interrogatories on the New Hampshire Radiological Emergency Response Plan.
Thank you for your patience in awaiting these Answers.
l l
As I have informed you, the State of New Hampshire at the present time does not intend to call any witnesses as to the adequacy of the New Hampshire Radiological Emergency Response Plan.
Because we filed no contentions and intend to offer no testimony on the state plan,.it remains my position that New Hampshire is not obligated to respond to any interrogatories on the New Hampshire state plan.
This position is consistent with the Board's March 1, l
1983 Order relative to discovery on the so-called technical safety l
issues.
There the Board held that. interrogatories which are not sponsored by the interrogee and which will not be the subject of l
direct testimony proferred by the interrogee, need not be answered.
Memorandum and Order, dated March 1, 1983, pp.
3-4, 7.

Recognizing, however, that New Hampshire state personnel involved in developing the state plan can provide valuable input in this proceeding on emergency planning issues, we have voluntarily answered NECNP's interrogatories.
In this light, it is my hope that we resolve any questions concerning the form and scope of discovery in a cooperative fashion.
Yours truly, 6
