Dear Tom:

This is to follow up our telephone conversation of last Friday, May 5. As I told you, we received over the telecopier a letter to Attorney Allan Fierce from you dated May 5 and in reading it, it became very clear that you were under the incorrect impression that the Seacoast Anti-Pollution League was withdrawing the testimony of Captain Daniel Breton and John Van Gelder, firefighters for the Town of Salem, New Hampshire regarding SAPL Contention EX-12 Reception /D?; contamination Centers. As I told you, I can only imagine that there was some misunderstanding that developed in the course of your scheduling discussions with the Commonwealth of Massachusetts. SAPL has not to this date ever entertained the notion of withdrawing that testimony.

We have not yet received the copy of the Commonwealth's proposed hearing schedule. It is our understanding that our witnesses will be fairly flexible as to time availability, and the only dates that I am aware of at present on which they might not be available are May 18 and May 19.
