STATE OF NEW !!AMPSilIRE NUCLEAR DECOMMISSIONING FIllANCIllG COMMITTEE In Re Seabrook Station - Unit 1 Docket NDFC 91-1 QNIGILQH_ TQ_XQTI ON FO R_,RElf E A RIRQ New llampshiro Yankoo (NilY) objects to the Motion for Rehoaring of the office of consumer Advocato (OCA) on the grounds that it is prematuro. In support of this Objection, N!!Y says

1. RSA 541:3 and RSA 162-F 21 and 22 should be construed in a manner that gives offect to the ovident logislative intent.
2. RSA 162-F 22,II(b) providos in portinent part, "The committoo shall hold at least one public hearing relative to establishing the revisoc funding schedule consistent with the public hearing roquiromonts delineated in RSA 162-F 21."
3. For purposes of the public hearing requirements, there is no good reason to distinguish betwoon hearings conducted under il of RSA 162-F 22 and hearings conducted under $II of that section.
4. Thus, whether under $I or TII of RSA 162-F:22, the procoodings should be conducted in a manner that is "consistert with the public hearing requirements delineated in RSA 162-F:21."

RSA 162-F:22,II(b).

5. RSA 262-F 21,IV providos that, after the Committoo has deliberated on the evidence and established a plan for scheduled i

payments, it shall make that plan available for public review and then hold a public hearing.

6. As the Committoo's prior practico confirms, the statuto contempIntos a 2-phase process: (A) an evidence-collecting and plan-establishing phase, which the Committee has proporly conducted with public hearings; and (B) a plan-commenting phase, in which further public hearings are conducted before the Committoo rLaches a final order.
7. It is from the order that emerges from a Phase 2 proceeding that a motion for rehearing may be properly filed pursuant to RSA 541:3.
8. The plan that emerges from a Phaso 1 proccoding is not yet a final " order or decision" within the contemplation of RSA 541:3.

A. An Order denying the OCA's Motion for Rehearing without prejudice to the OCA's right, undr RSA 541:3, to move timely for rohearing on any final order and decialon that the Committee makes after the Phase 2 proccoding.
