YQ1 THE TOWN of MERRIMAC M ASSACH'USETTS 01860 JER OF THE BOARD OF SELECTMEN June 15, 1987 Finding has been made that Public Service of New Hampshire /Seabrook requested permits to erect poles pursuant to M.G.L. Ch 166. M.G.L. gives authority to erect poles for the purpose of conducting transmission.

There is no transmission of power from the poles in question. The Board of Selectmen did not have the authority to issue permits since the poles were not for transmission of power. Public Service of New Hampshire /Seabrook were in error at the time of the permit application since they relied on M.G.L. Ch 166 which does not authorize erection of poles for any other reason than conducting transmission. This matter is properly before the Board of Selectmen this evening since the Board retains jurisdiction on any matter brought before it.

Therefore it is moved that the Board of Selectmen finds that the permits issued to Public Service of New Hampshire /Seabrook were void from inception and invalid from the date of issuance and that alternatively, the Board of Selectmen rescinds its vote taken March 17, 1986, revokes the permit for the poles and sirens, for grounds stated above, orders that the poles be removed within fourteen (14) days or that the Board may take whatever action is necessary to cause removal of the poles if they are not removed within the fourteen day period.

Further, by this motion, Public Service of New Hampshire /Seabrook is notified that the installation of batterier and solar collectors is in vicelation of an order by the Boaru of Selectmen dated June 2, 1986 and l removed.
