NDFC 91-1 NUCLEAR DECOMMISSIONING FINANCING COMMITTEE SEABROOK NUCLEAR DECOMMISSIONING FUND NEW HAMPSHIRE YANKEE'S REPLY TO NELKENS RESPONSE TO OBJECTION ON DISCOVERY REOUESTS 1.
Relevance here must be de* ermined with reference to RSA 162-F:1,II and 14 et seq.

RSA 162-F:1,II provides in pertinont part, "The legislature
. hereby establishes a procedure which will provide assurance of adequate funding by utilities for the decommissioning of those nuclear electric generating facilities which corolete their anticipated enerav-producir,a lives."
(Emphasis added.)

In its Report and Order dated June 2, 1989 at pp.
8-9, this Committee itself ruled:
Under the provisions of Chapter 162-F, Sections 14-26, the Committee has two fundamental issues to decide:
1.
The amount of the Nuclear Decommissioning Financing Fund to be established for the Seabrook I Nuclear Station.
2.
The amount of the regular monthly schedule for payments into th9 Nuclear Decommissioning Financing Fund to reach the amount established.
4.
The issues here are identical, except that they concern
" changes" in the " established" amount and its related monthly payment schedule.
Compare sections 22 and 21 of RSA 162-F.
5.
Nelkens Data Requests 2 a-d, 3,
4, and 11 are not relevant to those statutorily prescribed issues.

Nelkens Data Request 11(c) is objectionable for an additional reason: it would chill or adversely affect unfettered quality-assurance self-criticism.
