This is in reply to your letter dated November 24, 1980 requesting infomation for FEMA's response to offsite emergency planning contentions for the TMI restart hearings. Your request consists of much more than the ,

provision of existing documents in the fom of plans, programs and procedures.

It also includes the preparation of additional procedures and programs at  ;

State and county level, and the explanation or answers to questions regarding j county and municipality radiological emergency planning. ,

The Regional Assistance Committee (RAC) was provided between March and June 1980 all of the formal documentation available and, in our view, necessary for the review of State and county plans for offsite TMI planning according to NUREG-0654 (list attached). Therefore, all fomal documentation related to your list 'of " material" which is presently available to this agency has been provided to FEMA. The development of documentation, or changes to existing documentation, is a part of the ongoing planning process in this Agency to support our effo t to update the document package for the formal FEMA review under NUREG-0664. To act on your request at this time is not l

expedient as it would require, specifically for the TMI restart hearings, the development of specific procedures, the modifying of existing plans or the research of specific questions, much of which would require visits to the appropriate counti2s. It is believed better that documentation be up-

! dated or developed properly in conjunction with the RAC review process l rather than on a. super-expedited and selective basis for FEMA input to the TMI restart hearings as you suggest.

It is our understanding that for the purposes of the TMI restart hearings an "in process" evaluation of State and local planning will be provided by FEMA to NRC by January 5, 1981 (which recognizes that the C 4.a n-wealth planning effort conforming to NUREG-0654 guidance is not complete but identifies whether reasonable progress is being made). This does not appear to support a crash requirement separate from the RAC review process calling for full conformance with selected items in NUREG-0654 in order to support FEMA's input to the TMI restart hearings.

Johnson December 4, 1980 Page Two The Commonwealth believes that for the TMI restart hearings the best response to a question relating to emergency planning is provided by the agency or jurisdiction which has purview over that question. Questions relating to State, county or municipality planning should be addressed to the person, position or agency responsible for that planning. Therefore, the Commonwealth has responded to offsite State planning contentions or interrogatories, but not to offsite contentions or interrogatories regard-ing. county or municipality planning. The same approach will be used when the Commonwealth prepares its direct testimony for the TMI restart hearings.

For instance, Emergency Planning Issue No. 2 (EP-2) regarding care and re-location of livestock is a contention responded to by the Pennsylvania Department of Agriculture and EP-14-V regarding York County specific imple-menting procedures of the county plan is a contention which should be re-ferred to York County. It is believed that this is the best way to pmvide -

for response to additional questions regarding initial responses to con-tentions or 1nterrogatories which may develop during testimony. It is suggested that FEMA consider taking the same approach in dealing with off-site contentions--i.e., " expert" testimony should be referred to the actual

" expert".

The Cormonwealth has responded to those offsite contentions which address State planning. These responses have been distributed to all parties and the Board in the.TMI Unit I proceeding and are available from NRC staff counsel.
