4 In accordance with 10 CFR 50.4(b)(1), enclosed is TMI-2 license amendment request No. 77.

The purpose of this request is to clarify the authority to possess radioactive materials without unit distinction, so that after the transfer of the TMI-1 license to AmerGen, radioactive materials may continue to be moved between the TMI-l and TMI-2 units as they currently are. After the license transfer, GPU Nuclear will need access to the waste handling and processing facilities at TMI-l (currently conunon facilities) for its normal PDMS activities. Similarly, AmerGen as the TMI-1 licensee and PDMS contractor, will need to move radioactive apparatus and materials between units. This amendment clarifies that these normal, ongoing activities may continue after the license transfer. The amendment would not authorize receipt or possession of radioactive waste from other sites.

Using the standards in 10 CFR 50.92, GPU Nuclear has concluded that these proposed changes r do not constitute a significant hazards consideration, as described in the enclosed analysis performed in accordance with 10 CFR 50.91(a)(1). Also enclosed is a Certificate of Service for this request, certifying service to the chief executives of the township and county in which the l facilities are located, as well as the designated oflicial of the Commonwealth of Pennsylvania, J Bureau of Radiation Protection. The approval of this license amendment request is requested to be handled on an expedited basis <

to allow uninterrupted continuation of past practices associated with the movement and storage of radioactive materials on the TMI site. Thus it is requested to be approved as soon as practicable.

It is also requested to be made effective upon the TMI-l sale closure and transfer date. A similar license amendment request is being submitted to clarify the authority in the TMI-l license.
