SUBJECT:

REPORT NOS. 50-269/89-37, 50-270/89-37, 50-287/89-37 Thank you for your response of February. 16, 1990, to our Notice of Violation issued on January 17, 1990, concerning activities conducted at your Ocone facility under NRC Operating Licenses Nos. DPR-38, DPR-47 and DPR-55. We have evaluated your response and found that it meets the requirements of 10 CFR 2.20 However, we felt it necessary to respond to several statements in your letter of response:

1. Paragraph (2) states in-part that calibration standard 40367 has been inspected visually, and a cross-section has been metallographically examined. Minor processing laps were found, but no cracks were observe The laps would have minimal effect on the ultrasonic examination, and in any case would, at worst, cause an increase in examination sensitivit ASME Section XI, Appendix III, paragraph 111-3420, states:

"The finish on the surfaces of a block shall be representative of the surface finishes on the piping."

The pipe examined did not have surface discontinuities and no ultrasonic transfer methods were used to determine acoustical differences prior to the examination. In addition, the surface discontinuities noted by the inspector were in the circumferential direction, and since this block was fabricated from either seamless pipe or bored bar stock (both of which would have been drawn in the axial direction), the orientation of the discontinuities identified as laps appears confusin Therefore, please have a copy of the metallurgical report available for review during the closeout inspection for this violatio. Paragraph (4) of your response states in-part that Duke Power Company feels this violation has no safety significance since no incorrect examinations were performed, and the ultrasonic inspector took the proper actions to correct the calibration standard discrepanc Please note, however that the NRC inspector discovered the problem before potentially erroneous inspection results were recorde Furthermore, even after the error was discovered the Duke Corporate Level III examiner and other Corporate NDE Specialists, who were party to three lengthly conversations with the inspector (including the exit meeting),
