Gentlemen:

SUBJECT: NOTICE Of VIOLATION

(INSPECTION REPORT NOS. 50-269/90-06,50-270/9006ANDE0-287/90-06)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by

W. Tobin at the Oconee Nuclear Station on February 12-16, 1990.

The inspection

included a review of a Safeguards Event involving a previously terminated

contractor having been granted unesrcrted protected area acces> on January 15,

1990.

You will recall that similar events (although not involving an actual

protected area entry) were documented in your Safeguards Event Report of

February 22, 1969, and further discussed at an Enforcement Conference held on

August 29, 1989.

The findings of this inspection indicate that the corrective measures you took

to prevent terminated contracter employees having valid access badges

available at the sito entrance have not been completely (.ffective.

The

January 15, 1990, event could have been prevented, or at least mitigated, had

the responsible contractor followed established guidelines for the proper

processing of tenninated contractor employees.

We realize there has been limittd time available to fully implement the

corrective ections discussed at our August 1989 Enforcement Conference and in

your Safeguard Event Report oated February 19, 1990.

You should ensure that

your corrective actions tire comprehensive to prevent this type of event from

recurring.

The violation, references to portinent recuirements, and elements to be

included in your response are described in the enclosed Notice of Violation.

Specifically, your attention is focused to completed corrective actions

relative to your contractors programs.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure.

Therefore, the enclosures

to this letter with the exception cf the report cover page, which presents a

nonexempt summary, will not be pieced in the NRC Public Document Room,
