Gentlemen:

Subject: Inspection No. 50-286/82-09

This refers to the routine safety inspection conducted by Mr. R. Paolino of

this office on June 1-4, 1982 at the Indian Point Nuclear Generating Station,

Unit 3, Buchanan, New York of activities authorized by NRC License No. DPR-64

and to the discussions of our findings held by Mr. Paolino with yourself and-

other members of your staff at the conclusion of the inspection, and to subsequent

telephone discussions between Mr. D. A. Beckman and Mr. R. Paolino of this

office with Mr. J. Dube of your staff on June 8 and 9,1982.

Areas examined during this inspection are described in the NRC Region I Inspection

Report which is enclosed with this letter. Within these areas, the inspection

consisted of selective examinations of_ procedures and representative records,

interviews with personnel, and observations by the inspector.

Based on the results of this inspectior., it appears that one of your activities

was not conducted in full compliance with NRC requirements, as set forth in

the Notice of Violation, enclosed herewith as Appendix A. This violation has

been categorized by severity level in accordance with the NRC Enforcement

policy (10 CFR 2, Appendix C) published in the Federal Register Notice (47 FR

9987) dated March 9, 1982. You are required to respond to this letter and in

preparing your response, you should follow the instructions in Appendix A.

Another activity appears to be a Deviation from a commitment made in your

letter of August 15, 1980 (PASNY letter IPN 78-80) provided in response to NRC

staff requests in an NRC letter of May 21, 1979 and used as a basis for the

NRC Safety Evaluation Report issued with Amendment 24 to License DPR-64. In

your letter, you stated that closed head, horizontal _ side-wall type fire

suppression sprinkler nozzles would be installed to protect certain safety

related cable trays. We have found, however, that you have not installed

nozzles of the specified type and that the radial pattern nozzles actually

installed may provide insufficient fire suppression. In conjunction with your

response to Appendix A, please provide a written reply addressing this matter,

including the corrective and preventive steps you have taken or will take, the

date when corrective action will be completed, and the circumstances which

permitted this Deviation to occur.

The responses directed by this letter and the accompanying Notice are not

subject to the clearance procedures of the Office of Management and Budget as

required by the Paperwork Redu t f 8 L 96-511.

In accordance with 10 CFR 2.790(a), a copy of this letter and the enclosures

will be placed in the NRC Public Document Room unless you notify this office,

by telephone, within ten days of the date of this letter and submit written

application to withhold information contained therein within thirty days of

the date of this letter. Such application must be consistent with the require-

ments of 2.790(b)(1). The telephone notification of your intent to request

withholding, or any request for an extension of the 10 day period which you

believe necessary, should be made to the Supervisor, Files, Mail and Records,

USNRC Region I, at (215) 337-5223.
