Dear Mr. Eustis:

Your letter of October 14, 1988 to Chairman Zech, urging the Nuclear Regulatory Commission (NRC) take action to proceed immediately to restart Pilgrim and license Seabrook, has been referred to me for response.

As you know the Atomic Energy Act designated that the Federal Government control the possession, use and production of atomic. energy whether such energy sources are owned by the Government or by others licensed by the NRC. The NRC is careful to assure that its regulation of nuclear power is conducted in accordance with the provisions of the Atomic Energy Act, as amended, and the applicable Federal statutes.

With regard to operating the Pilgrim and Seabrook facilities, the NRC, in carrying out its responsibility to ultimately decide this matter, will use the best information available_ with a full awareness of our responsibility for the protection of public health and safety. We take this responsibility very seriously. We believe we are taking the necessary steps to assure ourselves that the Seabrook plant will not commence operation and the Pilgrim plant will not restart unless and until we are fully satisfied that safe operations can be performed and that the public health and safety is protected.
