Dear Mr. Daley:

This letter is being submitted pursuant to 40 CFR 61.150 (d) (4) and in accordance with your letter dated July 1, 1994 confirming that Virginia Power's procedure for tracking low-level radiologically contaminated asbestos waste (RCAW) is acceptable for maintaining compliance with the National Emissions Standards for Hazardous Air Pollutants (NESHAP) regulations. This is official notification that Surry Power Station has not received a copy of the waste shipment record, signed by the owner or operator of the designated waste disposal site within the 45 days since the waste was shipped off-site.

On December 19, 1994, RCAW (Shipment S94-14) was shipped from Surry Power Station to Scientific Ecology Group, Incorporated (SEG). A copy of the asbestos waste shipment record is attached for your review. Once the interim process is complete, the waste is scheduled to be shipped to Barnwell Waste Management Facility in Barnwell, South Carolina for final burial. The interim process is taking longer than expected and the signed waste shipment record was not returned to Surry Power Station within 35 days. Therefore, a search was initiated to determine the status of the waste shipment. The waste shipment is still located at SEG.

On January 23, 1995, the 35th day, Surry Power Station received written notification that Shipment S94-14 had reached SEG and that the waste will be processed and buried by the end of the first quarter of 1995, (after February 2, 1995, the 45-day reporting requirement). A copy of the SEG notification was forwarded to Virginia Power's Air Quality Department and is attached for your review.

Once Surry Power Station receives the waste shipment records, and the signed original, the Air Quality Department will be notified and.then will notify the Environmental Protection Agency that the outstanding waste shipment record has been received and closed.
