Dear Mr.' King:

This letter is to advise you pursuant to 40 C.F.R. § 61.150(d) (4) that Virginia Power has had four recent shipments of asbestos wastes that may be viewed as triggering the 45-day reporting requirement under the above regulation. Each shipment included potentially radioactive asbestos-containing wastes generated at either the Surry or North Anna Nuclear Power Stations.

Because of the high disposal cost and limited capacity and number of disposal repositories for low level radioactive waste, it is the practice in the nuclear industry for such low level wastes to be transferred first from the site of the generator to a processing contractor and then from the processing contractor to one or more disposal repositories. / Two contractors, Quadrex and Scientific Ecology Group, Inc. (SEG), provide processing services for Virginia Power. Typically, low level wastes, including asbestos-containing wastes, are received by these contractors and held for compaction into "discs" that may be stored in drums and then transferred to a licensed repository for final disposal. Wastes received by the processing contractors are held by those* contractors until sufficient wastes are received from one or more sources to warrant a shipment to a waste repository.

In* the case of each of the referenced shipments for Virginia Power nuclear facilities, the total time required from initial shipment to final disposal exceeded 45 days. While such shipments were made in full compliance with u. s. Nuclear Regulatory Commission and Department of Transportation requirements for shipment, handling and disposal of , low level wastes, the time between the initial shipment and final disposal for each of these shipments could be viewed as triggering reporting requirements under 40 .c.F.R. § 60.150(d) (4). Accordingly, we are submitting this letter to you regarding the status of these shipments *.

King December 23, 1991 Page 2 As noted above there have been four relevant shipments of wastes containing asbestos, three originating from the North Anna Power Station (May 9, 1991, May 23, 1991 and August 29, 1991) and one originating from the Surry Power station (February 8, 1991). The May 9 and May 23 shipments from North Anna were sent to Quadrex in Oak Ridge, Tennessee. From there, the non-radioactive portions of these shipments were sent to Middle Point Landfill, Murfreesboro, Tennessee, where they were received on June 11, 1991 (32.37 cubic yards) and July 10, 1991 (36.26 cubic yards), respectively. The radioactive portions of these shipments were processed by Quadrex and buried at Barnwell, South Carolina on October 29, 1991 (136.18 cubic feet) and October 30, 1991 (46.20 cubic feet).

The August 28 North Anna shipment went to Quadrex for processing.

A non-radioactive portion of this shipment (36.85 cubic yards) was received by the Middle Point Landfill on October 24, 1991. The final portion of this shipment has yet to be processed (i.e. ,

verified non-radioactive). We will advise you promptly when we receive confirmation of its burial.

The single shipment of asbestos-containing waste from Surry was shipped to SEG in Oak Ridge, Tennessee. We have been advised by SEG that this shipment was processed and shipped to Barnwell, South Carolina on March 4, 1991 (9.2 cubic feet) for burial.

The disposal practices outlined above are an appropriate and necessary approach to disposal of radioactive asbestos-containing waste. We believe these practices are consistent with the intent of NESHAP regulation, but we concede that they may result in more time between initial shipment and final disposal than is presently contemplated by those regulations.

Enclosed are copies of the waste shipment records for the shipment not yet delivered to the disposal repository. These forms were developed to meet U.S. Nuclear Regulatory Commission and Dept. of Transportation requirements for shipment and disposal of low level radioactive wastes and are therefore different in some respects from the NESHAP forms recommended by EPA.
