This letter refers to the routine safety inspection conducted by Messrs. W. B.

Grant and R. A. Paul on October 18-22, 1982, and by Messrs. L. R. Greger and R. A. Paul on November 30 and December 1, 1982, of activities at the Kewaunee Nuclear Power Plant. The attachment to this letter provides our response to the Notice of Violation detailed in the referenced report.

ATTACilHENT l Response to IE Inspection Report 82-20 Notice of Violation As a result of the inspection conducted on October 18-22, 1982, i and in accordance with the NRC Enforcement Policy, 47 FR 9987 (March 9, 1982), the following violation was identified:

10 CFR 20.203(f) requires that each container of licensed material bear a durable, clearly visible label identifying the radioactive contents.

Contrary to the above, numerous plastic bags and steel drums containing radioactive materials did not bear radioactive materials caution labels. One such container had a radiation level of 35 mrem / hour i on contact.

Response

Our failure to label contafcers of licensed material within a radiation area was brought to our attention during the Perfarmance Appraisal (81-27) as a potential enforcement finding. At that time, all containers for radioactive materials were examined to ensure proper labeling with any deficiencies corrected, and members of the radiation protection department were reminded of the requirements for container labeling.

These actions were completed prior to the more recent routine safety inspection when the item of noncompliance was identified. We concur with the finding and consider our actions to have placed ourselves within full compliance.
