Dear. Representative Wise:

Your letter of May 2, 1986, requested that the Nuclear Regula-tory Commission revoke the October 15, 1986 action of the NRC staff granting the request of Toledo Edison Company for authorization to dispose of low-level radioactive waste resins at the site of its Davis-Besse Nuclear Power Station.

Chairman Palladino has asked me to respond.

As you undoubtedly are aware, by order dated February 20, 1986, the Commission convened an adjudicatory proceeding in which concerns such as those expressed in your letter can be aired by interested persons who wish to question the propriety of the NRC staff's licensing action. Your letter has been placed in the docket for the proceeding for appropriate consideration by the Administrative Judge conducting the hearing. When the presiding officer has had an opportunity to consider all relevant concerns she will issue an initial decision on whether the Toledo Edison request was properly granted. The Commission will then undertake a review of that decision to determine whether it reflects an appropriate disposition of the licensing action in question.
