This memorializes and formally notifies MHB of our agreement, confirmed in the conference call with Judge Smith today,that the depositions of FMB, set in your subpoenae for the week of November 29, will not be held on those dates and will be deferred at least one week. Rescheduling of their depositions, taking into account their availability and any agreement between us on which League contentions will be litigated, should be included in the agenda of our discussions next week.
