I NRC DOCKET 50-366 OPERATING LICENSE NPF-5 i EIMIN I. HATOI NUCLFAR PLANT UNIT 2 WITHDRAWAL OF REQUEST TO AMEND OPERATING LICENSE Gentlemen:

Georgia Power Company (GPC) submitted to the NRC by letter dated November 23, 1983, a proposed license amendment for supplemental license conditions to be in effect during the replacement of recirculation system and certain attached piping at Hatch Unit 2. Due to the uncertainty in the licensing process, the proposed license amendment was submitted with the prevision that should our 10 CFR 50.59 evaluation and the NRC staff's guidelines conclude that a license amendment is not needed, we would withdraw the request for amendment.

The NRC staff presented its proposed guidelines for piping replacement to several boiling water reactor owners during a meeting in Bethesda on December 1, 1983. NRC concluded that the piping replacement may be perfomed under the provisions of 10 CFR 50.59 and that prior NRC approval (i.e., liceme amendment) is not necessary unless the proposed change to the facility involves an unreviewed safety question or a change in the Technical Specifications. A draft of the proposed guidance was provided to the attending owners by NRC and reportedly will be fomally issued at some later date.

GPC has completed its 10 CFR 50.59 evaluation for the replacement of the recirculation system and certain attached piping at Hatch Unit 2 and has concluded that such action does not constitute an unreviewed safety question. In addition, no changes to Technical Specifications are necessary to accommodate piping replacement. Consequently, GPC O!oo$$h6 PDR O

Stolz, Chief Operating Reactors Branch No. 4 December 16, 1983 Page ho will conduct the piping replacement under the provisions of 10 CFR 50.59 and hereby withdraws the proposed license amendment submitted by the aforementioned November 23, 1983, letter. Pursuant to NRC regulations and the applicable license, the appropriate reviews and analyses performed in accordance with 10 CFR 50.59 will be docurnented and maintained by GPC to permit the NRC staff to audit such evaluations, as necessary.

A copy of this letter will be sent to J. L. Ledbetter of the Georgia Department of Human Resources to provide notification of the withdrawal of the proposed amendment to the Hatch Unit 2 Operating License.
