HATCH NUCLEAR PLANT UNIT 2 WITHDRAWAL OF REQUEST TO AMEND TECHNICAL SPECIFICATIONS Gentlemen:

By letter dated October 20, 1983, Georgia Power Company (GPC) proposed to amend Plant Hatch Unit 2 Technical Specifications (Appendix A to the Operating License). GPC proposed to change the applicability of the limiting conditions for operation (LCOs) of systems and instrumentation associated with the cooling and protection of fuel in the reactor vessel after all fuel is removed from the vessel. The proposed change was submitted to accommodate the replacement of the main recirculation system i piping which will be done while the vessel is defueled.

Discussions with our NRC Project Manager indicate that the proposed change is not required based on NRC's interpretation of Technical Specifications concerning LCOs as they apply to the refueling mode (Mode 5) while the reactor vessel is defueled. The LCOs for Mode 5 would not apply since all fuel will be removed from the vessel during the piping replacement. Consequently, GPC wishes to withdraw its request to amend Technical Specifications as proposed in the aforementioned letter.

Withdrawal of the proposed change to Technical Specifications is contingent upon NRC providing GPC with a written interpretation of Technical Specifications concerning LCOs as they apply to Mode 5 while the reactor vessel is defueled.

With regard to our NRC Project Manager's comments concerning a possible change to Technical Specifications for seismic monitoring and fire detection instrumentation (T.S. 3.3.6.2 and 3.3.6.8, respectively) during the piping replacement, it is our interpretation that the " Action" statements in those G311220364 831116 PDR ADOCK 05000366 1 P ppp 9 -

Stolz, Olief Operating Reactors Branch No. 4 November 16, 1983 Page Two particular Technical Specifications make allowances for periodic instrument inoperability. Consequently, any inoperability associated with the seismic monitoring and fire detection instrumentation as a result of the piping replacement will be handled in accordance with the " Action" statements specified in the Technical Specifications for those particular instruments.

A copy of this letter will be sent to J. L. Ledbetter of the Georgia Department of Human Resources to provide notification of the requested withdrawal of-the proposed Technical Specification change.
